In some cases, prisoners cannot benefit from conditional release provisions.
The situations in which the conditional release clauses cannot be applied are as follows:
– In the event that the provisions of recidivism are applied for the second time, the convict is not released conditionally (5275 m.108/3),
-Convicts whose death sentence is commuted to imprisonment in accordance with Law No. 4771 cannot benefit from the provisions of conditional release.
-Second Book of the Turkish Penal Code No. 5237, Chapter Four, Chapter Four titled “Crimes Against the Security of the State”, Chapter Five titled “Crimes Against the Constitutional Order and Its Functioning”, Chapter Six titled “Crimes Against National Defense” In case of “conviction to aggravated life imprisonment” due to being committed within the framework of the activities of an organization, the provisions of conditional release do not apply (5275 Article 107/16).
