In the incident that took place in the form of swearing at the police officers who came to him after the child dragged into crime disturbing the environment by drinking alcohol, resisting when they wanted to take him to the police station, and breaking the window of the interview room in the police station, the actions of the child dragged into crime were determined by the Turkish Penal Code No. 5237, 125/1, 3-a, 4, 31/3, 265/1, 31/3, 152/1-a, 31/3. 66/1-e, 66/2 of the same Law, according to the upper limit of the penalties foreseen for these crimes. The statute of limitations of 5 years and 4 months specified in Articles of Association has occurred from the date of decision, 13.03.2015, until the date of examination,
Since the appeal objections of the defense counsel of the juvenile delinquent and the public prosecutor of that place were deemed appropriate in this regard, the provisions were VOID for the reason explained, and since the reason for the reversal did not require a retrial, the CMUK numbered 1412, which is still in force in accordance with Article 8 of the Law No. 5320. Based on the authority given by the article 322, the public action brought against the juvenile delinquent is under Article 223/8 of the CMK no. 5271. It was decided unanimously on 10.01.2022 to REDUCE it pursuant to the article.
