Liquidation When a Spouse Dies

When the marriage union ends with the death of one of the spouses, the property regime between the spouses is liquidated before the inheritance is shared between the surviving spouse and children and other heirs. After the surviving spouse receives half of the deceased’s “acquired property”, the inheritance is divided. The estate consists of “half of the acquired property and personal property” of the deceased spouse. When the inheritance is shared, the surviving spouse, who is the heir with his children, receives ¼ inheritance share. If there is a “family house” owned by the deceased spouse during the marriage, the surviving spouse has the right to demand that the ownership of the family house be given to him “as a deduction for the inheritance share”.
