WHAT ARE IMMEDIATE BEHAVIORS?

In order for the crime of indecent acts to occur, it is necessary to act against the morals and morals of the society. Behaviors such as performing sexual acts, showing his genitals, having sexual intercourse in public constitute a crime.

The perpetrator of the crime can be anyone. Crime is not a specific crime. However, the victim of crime can be the whole society.
It is a crime committed by choice. If one of the actions specified in the law is made (public intercourse or exhibitionism), a crime will be committed.
The crime of indecent acts and the crimes of disturbing one’s peace and tranquility are confused with each other. However, there are differences in the elements of both crimes. The most important element in the crime of disturbing the peace and tranquility is “continuity”. When the act of the perpetrator is repeated enough to tire the other party and disturb his peace, the crime of disturbing the peace and tranquility will be committed. If the perpetrator commits a crime with an act and does not do this act frequently, the crime of disturbing the peace and tranquility will not be committed.
PUNISHMENT FOR THE CRIME OF indecent acts
The person who commits the crime of indecent acts will be punished with imprisonment from 6 months to 1 year.
Judicial fine is the conversion of prison sentences of 1 year or less into money. It is possible to impose a judicial fine because the sanction of the crime of indecent acts is 1 year or less. However, after it is converted into a judicial fine, the penalty will be converted into a prison sentence even if the person does not pay the fine.
The decision to defer the announcement of the verdict is made in the name of penalties of 2 years or less. If the decision to defer the announcement of the verdict (hagb) is made, the person must not commit a crime during the inspection period. Even though he has not committed any other crime during the inspection period, the punishment will end without any consequences at the end of the period. It is possible to give the decision to postpone the announcement of the verdict in the crime of indecent acts, in accordance with the limit of the penalty.
Suspension of prison sentence is given in the name of penalties with a sanction of 2 years or less. The penal sanction is 3 years for persons who have not completed the age of 18 or who have attained the age of 65. In case of a decision to postpone the sentence, the person will be conditionally waived from the execution of the sentence. It is possible for the decision to postpone the sentence, to be given the crime of indecent acts, in accordance with the sanction limit.
Compromise on the crime of dishonorable acts
In crimes subject to mediation, the file will be sent to the mediation office by the prosecutor’s office if it is at the investigation stage, and by the court if it is at the prosecution stage. Since the offense of indecent acts is not subject to reconciliation, reconciliation procedures will not be applied.

Complaint On Crime Of Indecent Acts

The offenses subject to complaint are specified in the Turkish Penal Code. In the crimes that are subject to the complaint, investigation and prosecution has been subject to the complaint. Therefore, when the complaint is withdrawn, the trial phase will also end.

However, the crime of indecent acts is not a crime subject to complaint. For this reason, the investigation will be initiated ex officio (spontaneously) by the prosecutor’s office. The fact that the victim of the crime does not make a complaint will not have an effect at the trial stage.

Timeliness On Crime Of Indecent Acts

If a lawsuit is not filed from the date the crime was committed, or if the lawsuit is not filed within a certain period of time, the statute of limitations will expire. The statute of limitations is 8 years.
