1- What is the Crime of Deliberately Endangering General Security? It Is Defined In The Turkish Penal Code as follows
“In a way that is dangerous for the life, health or property of people or in a way that may cause fear, anxiety or panic in people; A) Causes fire, b) Building collapse, landslide, avalanche, flood or overflow, c) Anyone who shoots with a gun or uses explosives is punished.
“The person who causes the danger of fire, building collapse, landslide, avalanche, flood or overflow shall be punished.”
It is the prevention of comprehensive endangerment of persons and property of legal value protected by the crime of Intentional Endangerment of General Security. For this reason, the crime of Intentionally Endangering the General Security is regulated in the “Crimes That Create General Danger” section of the Turkish Penal Code. As it can be understood from the text of the crime article, it is an optional mobile crime. The elective actions of this crime are shown as causing fire, building collapse, landslide, avalanche, flood or overflow, shooting with a gun or using explosives. The fact that these acts constitute a crime is conditional on the realization of a concrete danger. The crime also has a second paragraph. Abstract danger crime is included in this paragraph.
2- What is the Crime of Endangering the General Security by Negligence? It is Defined as follows in the Turkish Penal Code
“By negligence; a) Fire, b) Building collapse, landslide, avalanche, flood or overflow, The person causing the action is punished if the act is dangerous in terms of the life, health or property of others.
3- Punishment for Deliberately Endangering General Security
In a way that is dangerous in terms of life, health or property of people or in a way that may cause fear, anxiety or panic in people; a) Causes a fire, b) Causes building collapse, landslide, avalanche, flood or overflow, c) Fires with a gun or uses explosive materials, is sentenced to imprisonment from six months to three years. (Turkish Penal Code 170/1)
A person who causes fire, building collapse, landslide, avalanche, flood or overflow danger is punished with imprisonment from three months to one year or a judicial fine. (Turkish Penal Code 170/2)
4- Penalty of Endangerment of General Security by Negligence
by negligence; a) Fire, b) Building collapse, landslide, avalanche, flood or overflow. The person who caused the act is punished with imprisonment from three months to one year if the act is dangerous for the life, health or property of others. (Turkish Penal Code 171)
5- Are the Crimes of Intentional or Negligent Endangerment of General Security Subject to Complaint?
No… Deliberately or Negligently Endangering the General Security crimes
they are not. These crimes are investigated ex officio by the prosecutor’s office.
6- There is No Timeout for Crimes of Intentionally or Negligently Endangering the General Security !!!
