DESCRIPTIONS :

 

1-) At the session of your court dated …, our statements on the merits that we submitted within the time given to us are as follows.

 

2-) Our client, who is only ….. years old, has been subjected to sexual harassment by the accused, as we have clearly stated in our petition. Since the accused is the brother of a close friend of our client and also has neighbors, the case is more serious. Since our client is at an age that can be considered a child, he has a brotherly closeness and trust to the accused, and consented to the idea of ​​getting on his bike and walking around together, and approached with a childish enthusiasm.

 

3-) Defendant’s defense counsel has tried to deny the sexual harassment crime in his petition dated …/…/…. However, our client, who is a child at that age, cannot create or fabricate this situation in his own mind. When she returned home in shock and fear of the incident, the incident came to light when she doubted her mother’s actions and went over her and, so to speak, tried to take words from her mouth.

 

4-) Our client is unable to handle this situation due to his age and position. He even wants one of the elders of the family to go with him while going to school. This situation will become clearer with the forensic medicine institution report to be obtained.

 

5-) As a result of this incident, the accused continued to act as if nothing had happened and to go in and out of the client’s house using something as an excuse and based on their being neighbors, and our client became afraid to leave his room every time he saw him. In his defense on the merits, the defendant’s defense made a defense that “our client did not have any intent”. However, it is not possible for the crime of sexual harassment to be committed against the will and intent of the accused.
