What is Poverty Alimony

It is the type of alimony that the spouse who will fall into poverty due to divorce may request from the other spouse in order to ensure his livelihood and the continuity of his life. The spouse requesting alimony should not be more severe than the other spouse in the divorce. Again, in case of equal fault, poverty alimony can be requested if other conditions are met. Poverty alimony is paid to the former spouse who has fallen into poverty once or every month after the divorce decision is finalized. This alimony can also be requested in a separate lawsuit after the divorce case.

However, if the divorce was realized as a consensual divorce and poverty alimony was not requested in the protocol, then poverty alimony cannot be requested with a separate lawsuit. The general belief among people is that working people cannot receive alimony. This is true in a way; However, there are some cases where alimony can be decreed for people who have high standards during marriage, but who will be in serious trouble despite working after divorce. There are Supreme Court decisions regarding this. It is stated in the Law that alimony can be given “indefinitely”; but not in any case indefinitely.
