An Attorneyship fee agreement has been made between the parties whose names and addresses are mentioned above, with the following conditions. The owner of the job (CLIENT) and the lawyer who took the job are named simply (ATTORNEY). A fee agreement has been made between the lawyer whose identity information is given and the employer, on the specified subject and in accordance with the aforementioned fee and the relevant articles of the Attorneyship Law, with the following conditions.
ARTICLE-1: The attorney’s fee to be paid to the lawyer for the work given to him and the advance of expenses to be notified by the lawyer shall be paid in cash at the beginning of the work. In return for the work subject to the contract, …% of the lawsuit price will be paid in cash to the lawyer at the end of the lawsuit.
ARTICLE-2: This fee is only for the work mentioned above. Even if it is related to this business, any other business arising from it will not be covered by this contract. In the event that a counter lawsuit is filed and other disputes and prosecutions arise regarding this matter, an additional attorney’s fee will be required to be paid to the lawyer. Also for the hearings to be held in the Supreme Court, the Council of State and other dispute resolution authorities. Attorney’s Fee will be paid separately, based on the Minimum Fee Schedule between the Bar Association Attorney – Attorney.
ARTICLE-3: The attorney will prosecute the job given to him by the client in accordance with the laws and professional rules until the end. He will be able to perform this task himself or to follow the work subject to the contract by cooperating with other lawyers under his supervision. However, in this case, no additional fee will be requested from the client. He will be jointly and severally liable to his client, both personally and together with the other lawyer, for the faults of the lawyers to whom he is assigned and the damages they cause.
The client cannot give a power of attorney to someone else without the written consent of the lawyer, and in case of any contrary action, the lawyer will be paid the full fee. In the absence of the lawyer’s consent, the client is obliged to pay the entire fee of the lawyer who does not consent.
ARTICLE-4: All expenses of the work will be covered by the client, in case the amount received as an advance does not cover the expenses, the lawyer can keep the work on hold until the expenses are paid, and he cannot be held responsible for any damages that may occur due to this situation. For the time being, the client pays ………………….TL to the lawyer for the expenses. will pay the advance.
When travel is required for this job, the client will pay the attorney for travel, accommodation and other expenses incurred due to this work, as well as pay ……………… TL for each day he is away from his office.
ARTICLE-5: If the client renounces the job or does not allow the attorney to prosecute the job or does not fulfill one of the obligations under the contract, the attorney will be entitled to demand the agreed percentage fee at the end of the case.
ARTICLE-6: The client has accepted the address shown above as a residence. Any notification made by the lawyer to him will be sent to this address. It is obligatory to notify the lawyer of the address changes, and the lawyer cannot be held responsible for the notifications that do not reach the client due to the change of address.
ARTICLE-7: If the contract is terminated unilaterally by the client, the attorney gains the right to demand the entire agreed fee as a percentage at the end of the lawsuit.
Article 8- The provisions of the Attorneyship Law are applied in cases that are not included in this contract and are not clear.
