SUBJECT OF THE REQUEST: It is the presentation of our objections to the claim of remuneration against the seizure made with the file numbered 2021/….. of the Ankara ….Executive Directorate.
DESCRIPTIONS
The file numbered 2021/….. of Ankara …. Enforcement Directorate replaced by the creditor-client (ANNEX-1) and the debtor of the file D…. The decision to place a lien on the properties of E…. has become final; ../../…. The property at the debtor’s residence address was seized for the collection of the client’s receivables.
Borrower D…. TO…. by ../../…. dated petition has been submitted to the file of your Directorate; With this petition, he claimed that the property of the seized goods belonged not to him, but to the third party A…..B….. It has been up to us to object to the unfounded claims that are the subject of this petition in due time. Namely;
The foreclosure process was carried out at the address of ……………………………….. Batıkent Yenimahalle Ankara, where the debtor of the file resides. The enforcement order has been notified to this address and this is the debtor’s residence address. Therefore, we object to the claim of remuneration made by the third party in this respect.
Although it was claimed that it was objected during the foreclosure process, neither the file debtor nor any person claimed that the property subject to the seizure did not belong to the file debtor during the transaction. With this claim of the third party, just like the other claim, it only aims to ensure that the enforcement proceedings are postponed.
