If a claim is made in the lien, it is written in the lien report by the bailiff. If the situation was not learned at the time of the lien, the claim for remuneration must be asserted within seven days from the learning of the lien. In the event that it is claimed in the claim of remuneration in this way, the situation is notified to the creditor by the executive directorate. If the creditor does not object within three days, the lien will be lifted. It is a situation that should be considered, as these periods are detrimental to their rights.
In the event that the debtor or creditor objects to the claim made by the third party within three days, the executive director has to send the file in question to the enforcement court immediately. The enforcement court evaluates the claim of remuneration over the file brought before it. In this evaluation, it is examined whether the claim of remuneration is real, sincere and convincing. Another issue that the court takes into account is whether the claim for remuneration was made solely for the purpose of preventing the realization of the attachment. The period of filing a lawsuit begins with the notification of the decision of the enforcement court to the third party claiming remuneration.
