What is Precautionary Alimony

Temporary alimony constitutes a temporary measure, it is the alimony that can be requested during the divorce case or before the divorce case, especially for the spouses to cover the accommodation, subsistence and care and expenses of their children. Temporary alimony can be given in favor of both the spouse and children. Unlike the poverty alimony, although there is no demand of the people, the judge may decide on the temporary alimony when he deems it necessary. Temporary alimony can also be requested with an independent lawsuit (separation lawsuit) without filing for divorce.

In this case, it is necessary for the person to prove that his separation from his spouse is based on justified reasons. In both the divorce case and the separation case, the alimony starts to run from the date of the case. Temporary alimony is intended to provide temporary protection. It ends automatically with the finalization of the divorce decision or the end of the separation period (a separation decision can be made for a maximum of 3 years). Finally, while deciding on the measure alimony, unlike the poverty alimony, the fault rates of the parties are not taken into consideration.
